12. The owner/s of lots having access along the joint permanent easement
(common driveway) shall be jointly responsible for the perpetual
maintenance of the joint permanent easement and all deeds for said
lots shall specify such mechanisms for maintenance.
13. The easement shown may contain additional lots and a shared drive
with improvements shall be built to accommodate said future lots.
Maintenance is the responsibility of all lots sharing the drive by way of
a Property Owner's Association, recorded separate from this plat.
14. There shall be a sight distance easement across the front of lots 1 and
2 (lot 3 may be further divided) of the Appalachian Construction LLC
Property contained within the 30' front setback as shown on the plat.
The primary responsibility for maintenance of the sight distance
easement shall be the individual lot owners of said lots. The Property
Owner's (or Assoc. ) for the Appalachian Construction LLC Property
(as registered separately from this plat) shall have the right to enforce
the sight distance easement in the event that sight distance easement
is not being properly maintained. The lot owners shall keep clear and
maintain the area identified as "Sight Distance Easement" along Nine
Mile Road from any permanent vegetation other than grass or sod (to
be mowed regularly). No other planted materials or any permanent or
temporary structures or signs above ground of any kind are permitted
in the sight distance easement.
